TPG Community Terms of Service

The TPG Community site (site) is owned and operated by TPG Internet Pty Ltd (ABN 15 068 383 737).

Use of the site is regulated by these Terms of Service.

You must be aged 18 years or over to use the site. By using of the site, you indicate that you accept these terms. If you do not accept these terms, do not use the site.

Purpose

The site is for TPG customers, partners, or other enthusiasts, but we welcome anyone with an interest in TPG to participate. To ensure a safe and engaging community, participants of the site are expected to observe these Terms of Service.

Conduct

You may not use your registration membership (or allow another person to use your registration membership) to post or transmit:

1. Content (including comments, images, documents) that is abusive, vulgar, obscene, hateful, fraudulent, bigoted, racially offensive, threatening or defamatory towards any person, whether between members or moderator or TPG staff.
2. Content that discloses private details or personal matters concerning any person. This includes phone numbers, addresses, emails, and other private details.
3. "Rants," "slams," or legal threats against TPG or another company or competitor.
4. Political or religious statements or commentary.
5. Off-topic comments not related to TPG Community.
6. Any material that you don't have the right to transmit under law (such as copyright, trade secret, or securities) or under contractual or fiduciary relationships (such as non-disclosure agreements).
7. Language that promotes illegal activity or discusses illegal activities with the intent to commit them. This includes any message that solicits or promotes the use of an illegal substance.
8. Advertising, promotional materials, or other forms of solicitation including chain letters, pyramid schemes, class action suits, or charitable appeals. This includes advertising links in signatures.
9. Any file or link to a file or a site that contains viruses, corrupted files, "Trojan Horses," or any other contaminating or destructive features that may damage someone else's computer.

1. Duplicate posts, spam messages, or posts repeated excessively on one or more boards.
2. Messages designed to evade profanity or other filters.
3. Hyperlinks that lead to sites that violate any of the forum guidelines.
4. Content that impersonates another person or affiliation with an entity, including, but not limited to, TPG.

In addition, our User Guidelines do not permit you to:

• Intentionally violate any law while using our site.
• Interfere with the site?s operations including but not limited to mail or "post" bombing, news bombing, other flooding techniques, deliberate attempts to overload a system and broadcast attacks, or attempts to avoid messaging blocking.
• Evading bans or suspensions or otherwise disregarding directions from TPG Community moderators or administrators. We may at any time and without prior notice remove any posted message, thread or user accounts that violate our User Guidelines or these Terms of Service.

User Profile Information

Your user profile must not use a screen name or email address that is already being used by someone else, impersonate another person, be a user profile that belongs to another person, violate the intellectual property or other rights of any person, be vulgar or otherwise offensive. We may reject, suspend or remove your user profile for not meeting the above standards. We may also reject, suspend or remove your user profile for any other reason, at our sole discretion. In consideration of your use of the site you agree that all information provided in your profile is accurate, true, current, and complete. TPG may terminate your account if any of the information provided is found to be inaccurate, false, out of date, or incomplete.

Content found on the site

The site relies on community participation so content found in the site comes from community members and from various sources. Content may be personal opinion, and may not be reliable or accurate. TPG makes no claims or representations as to the accuracy, completeness, or truth of any material submitted or found in the site. TPG is not liable for any website links posted within the discussion areas; website

links posted in the discussion areas may link to sites not administered or under the control of TPG and users must open such links at their own risk. TPG is not liable for any errors or delays in the content or transmission of postings on the site. We encourage you to exercise caution and common sense when considering the information provided by community members. TPG makes no guarantee of the confidentiality or privacy of any communication or information transmitted on the site, or any web-site linked to the site, or otherwise in connection with the services and TPG will not be liable for the privacy of e-mail addresses, registration and identification information, confidential or trade-secret information.

Unauthorised Use

If your user identification or password(s) is compromised, or if you become aware of any unauthorised use of your account or other breach of security, you need to promptly notifying us. You can notify us by sending an email to community@tpg.com.au.

Language

The language of the site is English.

Variation

TPG reserves the right to amend these terms of service at any time. Amendments will become effective upon posting of the amended terms on the site. Your use of the site after our posting of the amended terms constitutes your acceptance of the amended terms.

Disclaimer of Warranties

The service is provided on an "as is" basis without warranty of any kind, express or implied. You expressly agree that the use of the service is at your sole risk. TPG does not warrant that the service will be uninterrupted or error free, nor does TPG make any warranty as to any results that may be obtained by use of the service. TPG makes no other warranties, expressed or implied, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose, in relation to the service.

Limitation of Liability

To the extent permitted by law, TPG shall not be liable to you or any other person for any damages, including without limitation, direct, indirect, incidental, consequential or punitive damages arising out of or relating to these Terms of Service or the use of the service or site.

Indemnification

You agree to indemnify, hold harmless and defend TPG, its shareholders, directors, officers, employees and agents from and against any action, cause, claim, damage,

debt, demand or liability, arising out of or relating to: (a) your breach of this Agreement; (b) your use of the site, including any data or work transmitted or received by you; and (c) any libellous, slanderous, indecent or other statement concerning any person made or republished by you.

Governing Law and Venue

These Terms of Service constitutes a binding agreement. Breaching these Terms of Service may result in your account being suspended or terminated, and/or other legal action. These Terms of Service, the TPG Community User Guidelines constitute the entire agreement between you and TPG in relation to your use of the TPG Community Site. The law of New South Wales, Australia, governs these Terms of Service.
